The Responsible Tenant Rewards program (“RT Rewards” or the “Program”) is offered by REAL Value Management LLC (“RVM”), as the Property Manager for the landlord, to tenant(s) (“You” or “Your”) for a residential property selected by RVM for Program eligibility (the “Rental Property”) to provide an incentive for You to make full and timely monthly rental payments, sustain the Rental Property in good condition, provide updated information from time to time, and renew the annual lease in a timely manner. The Program is a separate and distinct offer from Your lease agreement, and at no time will the Program Terms and Conditions change or take the place of any conditions or requirements set forth in Your lease agreement. In accordance with these Program Terms and Conditions, You will receive a monthly amount of RT Rewards points and the ability to earn RT Rewards points. Upon successful completion of a Program Milestone in accordance with these Program Terms and Conditions you will receive a one-time net reduction of rent for the converted cash value of Your RT Rewards points.
  3. Program Cost: There is no additional fee for You to pay and no risk to You for participating in the Program.
  4. Enrollment: You have been automatically enrolled in the Program, effective immediately. To obtain more information related to your account, you may:
  1. Program Term: The “Program Term” begins with your enrollment in the Program and will end upon Your Termination from the Program, as described in Section 4.C below.
  2. Program Requirements: Continued membership requires that You satisfy ALL Program requirements, as identified herein, including, but not limited to:
          • RT Rewards Points: Upon signing of Your lease agreement, Your account will begin to accrue RT Rewards points determined as set forth in the schedule provided to You.
          • Qualification to Apply RT Rewards Points for Converted Cash Value: Once You are automatically enrolled in the Program, all of the following are required to successfully qualify for any RT Rewards points credited toward a converted cash value
                • Your RT Rewards account must be active as of the date that You are eligible to redeem your RT Rewards points; and
                • Your RT Rewards account must not have been terminated from the Program pursuant to these Terms and Conditions; and
                • The Rental Property must be in similar or better condition than when the lease agreement was signed; and
                • You must provide timely updated information as requested by RVM from time to time; and
                • The Rental Property must remain eligible for the Program at the sole discretion of RVM; and
                • You must be in full compliance with your lease terms and must not have made any late monthly rent payment on Your Rental Property during any three month(quarterly) period while You are in the Program; and
                • You must make full and timely payments on Your quarterly water and sewer bill
              • You must complete the annual lease renewal process before Your current lease expires.
          • Termination: Your participation in the Program will terminate on the date of the earliest to occur of the following:
                • You request termination of Your participation in the Program; or
                • You do not renew Your lease; or
                • Your Rental Property is transferred to an owner that terminates the Program; or
              • Your participation in the Program is deemed to be unlawful or otherwise unacceptable under: local, state or federal law; the order of any court of competent jurisdiction; any similar judicial or administrative order or action; or by RVM at any time in its sole discretion.
          • Forfeiture of RT Rewards: Your account is subject to partial or full forfeiture of any or all RT Rewards points, a ceasing of RT Rewards points accruals, or to disqualification from participation in the Program, all of which are at RVM’s sole discretion.
  1. Participation Conditions: By participating in The Program You agree to, and authorize, the following contact by RVM, including but not limited to its RT Rewards Representatives:
          • Communication of the Program and Your account information to You via postal mail, overnight mail, e-mail, cellular telephone and/or landline telephone (standard rates apply), at the discretion of RVM; and
          • Notice that You may have violated, or may be in danger of violating, Program Requirements; and
          • Communication regarding other services and products to be sent to you through Your RT Rewards account or by any other means.
  1. Notices to You:
          • RVM will provide You with the following notices or communications, as appropriate. Such notices may be provided either via postal mail, e-mail, text message*, as determined by RVM:
                • Notice of successful accrual of RT Rewards points amounts in the Program; and
                • Notice of non-accrual of RT Rewards points amounts in the Program; and
                • Notice of termination of Your account; and
              • Notice of other RT Rewards offers which may be available to You in connection with Your participation in the Program.
          • Notices sent to, or communications with, the tenant identified in the enrollment information for Your account shall be considered notice to, or communication with, all tenants on Your lease agreement for the purposes of meeting RVM’s obligations under the Program.
  1. Further Terms and Conditions:
      • RVM is solely responsible for the application and acceptance of Your RT Rewards in accordance with these Terms and Conditions.
      • RVM reserves the right to correct any errors with regard to Program operations or RT Rewards points amounts at any time and to amend these Terms and Conditions to reflect changes in law or industry practice that may affect the functioning of the Program, as determined by RVM.
      • By agreeing to participate in the program, You certify that You have read, understood, and agree to all Program terms and conditions contained herein.
      • All amounts credited to Your account remain the property of RVM until a one-time net reduction of rent for such payment is issued. You have no right to an RT Reward payment or to any amount credited to Your account until You qualify for issuance of an RT Reward payment under the Program Terms and Conditions.
      • An RT Reward payment is not a loan and may be subject to taxation. If You have questions about Your tax obligations related to the Program, You must consult Your tax advisor for guidance.
      • By activating Your account, You agree to hold harmless RVM from any liability arising from errors, omissions, system outages or delays in data transmission, that are associated with Your RT Rewards account or Your RT Rewards payment (if any) that occur at any time.
